Summary: By using ConvoType, you agree to these terms. Use our services responsibly, respect others’ data, and don’t misuse the platform. We’ll do our best to keep things running smoothly.
1. Acceptance of Terms
By accessing or using ConvoType Cloud (convotype.com) or ConvoType Pro (WordPress plugin), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our services.
These Terms apply to all users, including free and paid subscribers, form creators, and anyone accessing forms built with ConvoType.
2. Description of Service
ConvoType provides a conversational form builder available in two formats:
- ConvoType Cloud: A hosted SaaS platform for building, hosting, and embedding conversational forms on any website
- ConvoType Pro: A WordPress plugin that integrates natively with the WordPress block editor (Gutenberg)
Features, limits, and pricing vary by plan. Current plans and pricing are available at convotype.com/pricing.
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 16 years old to create an account
- One person or legal entity per account; accounts cannot be shared
- You are responsible for all activity that occurs under your account
4. Acceptable Use
You agree not to use ConvoType to:
- Collect personal data without proper consent or legal basis
- Send spam, phishing content, or malware through forms
- Create forms that are deceptive, fraudulent, or misleading
- Violate any applicable laws, regulations, or third-party rights
- Interfere with or disrupt the integrity or performance of our services
- Attempt to gain unauthorized access to our systems or other users’ data
- Resell, redistribute, or sublicense ConvoType without written permission
We reserve the right to suspend or terminate accounts that violate these terms.
5. Your Data
Ownership
You retain full ownership of all content you create and all form response data collected through ConvoType. We do not claim any intellectual property rights over your content or data.
Data Processing
When form respondents submit data through your ConvoType forms, you are the data controller and we act as the data processor. You are responsible for:
- Obtaining appropriate consent from form respondents
- Complying with applicable data protection laws (GDPR, CCPA, etc.)
- Providing your own privacy policy to form respondents
- Handling data subject access requests from your form respondents
Data Portability
You can export your form data at any time through the ConvoType dashboard or API.
6. Payment and Billing
- Free plans are available with limited features and usage caps
- Paid plans are billed monthly or annually, as selected at checkout
- All payments are processed securely through Stripe
- Prices are listed in USD and exclude applicable taxes
- You authorize us to charge your payment method on each billing cycle
- Failed payments may result in service downgrade or suspension after a grace period
7. Cancellation and Refunds
- You may cancel your subscription at any time from your account settings
- Cancellation takes effect at the end of the current billing period
- We offer a 14-day refund policy for new paid subscriptions
- After 14 days, remaining subscription time is not refundable
- Upon cancellation, your data remains accessible for 30 days, after which it may be deleted
8. Service Availability
We strive for high availability but do not guarantee uninterrupted service. We may:
- Perform scheduled maintenance with reasonable advance notice
- Experience unplanned downtime due to factors beyond our control
- Modify, update, or discontinue features with reasonable notice
For ConvoType Pro (WordPress plugin), availability depends on your own hosting environment and is outside our control.
9. Intellectual Property
ConvoType, including its design, code, features, and documentation, is owned by ConvoType and protected by intellectual property laws. You may not:
- Copy, modify, or reverse-engineer our software (except as permitted by law)
- Use our trademarks, logos, or branding without written permission
- Remove or alter any proprietary notices in our products
10. Third-Party Integrations
ConvoType may integrate with third-party services (webhooks, Zapier, email platforms, CRMs). We are not responsible for:
- The availability, accuracy, or security of third-party services
- How third parties handle data you send to them through integrations
- Any terms or policies of third-party services
11. Limitation of Liability
To the maximum extent permitted by law:
- ConvoType is provided “as is” without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim
- We are not liable for data loss resulting from your failure to maintain backups
12. Indemnification
You agree to indemnify and hold ConvoType harmless from any claims, damages, or expenses arising from:
- Your use of the services
- Your violation of these Terms
- Your violation of any third-party rights
- Content or data you collect, store, or process using ConvoType
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a prominent notice on our website at least 30 days before the changes take effect. Continued use of ConvoType after changes take effect constitutes acceptance of the updated Terms.
14. Termination
We may suspend or terminate your account if:
- You violate these Terms or our Acceptable Use policy
- Your account is used for illegal activity
- Required by law or legal process
Upon termination, your right to use ConvoType ceases immediately. We will provide 30 days to export your data unless termination is due to illegal activity.
15. Governing Law
These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the courts of competent jurisdiction.
